Can we as private citizens move towards impeaching the Supreme Court?

Expand full comment
John Coats's avatar

As I understand it, only the House of Representatives can impeach— bring charges— and only the Senate can actually try the person who has been impeached. All we as citizens can do is encourage our representatives to do the right thing.

That needs to change big time, after post fascist era! I want more direct power moved to people to remove supreme court,Congress people and president,if they engage in political malpractice. Waiting for elections is too long, and still empowers dark money.

The changes you want will take a constitutional amendment. By the same GQP congress you’re complaining about. And don’t fall for “we can have a constitutional convention!” Which would be under the same GQP . It’s a fever dream of Christian Nationalists. We have what we have, and all the whining won’t change it. Focus on what we can do. Vote out GQP. EVERY election. Every seat.

That's how it's supposed to work. They're supposed to represent us. But as we've all seen they seem to have decided to do the wrong thing. Evidently corporations and billionaires need more representation than We the People do.

And let Trump pick new justices? No way. Must cut off the head of the snake 🐍. Unfortunately with a MAGA congress, impeachment is the fever dream.

This is a definite concern. It use to be a 60 out of 100 senate votes to confirm a judge. In 2017 during trumps last term the Republicans changed this to a simple majority of senate votes which is 51 out of 100 senate votes now! A majority reason how Trump's first term packed the courts! These maga Republicans have been scheming for yrs! Mitch McConnell is also responsible for this & not convicting Trump in 2 impeachments the first term! He was the majority leader of the senate at the time. They're lied & deceived the American people for decades!

This was an excellent discussion, as I have come to realize all discussions with the Judge are. Too, it was frightening and disheartening. Like you, Terry, I have always been a glass half full person but my hope was shaken by the Judge’s closing commentary. I do hope the damage caused by this regime is reparable in the long run.

I totally agree with you. I was also dismayed by the Judge's closing thoughts. I am trying to "keep hope alive," as Jesse Jackson used to say, and right now it is hard, isn't it? Hang in...

I was moved -and somewhat disheartened, as I believe you appeared to be, listening to your conversation with Judge Luttig. I’m glad you concluded the conversation as you always do, Terry, with a silver of hope and optimism. That we’re in this together and we can do something. Without hope, we have nothing but darkness in this twilight zone we find ourselves in. Once again, outstanding guestions, and observations on your part, Terry. We need your voice.

The Supreme Court justices complicit are corrupt and can no longer be considered a court. They need to be reckoned with in their participation in this coup and the overthrowing of our country!

Once sanity is recovered we would benefit from a Hague-style approach in this country and lay down convictions and consequences; otherwise, it’s the same shit just another day in the life of politics

I agree, and hope we can do something about them in the not-too-distant future. Term limits are a good start but, unfortunately, this court has already done so much damage. :(

I would like to ask the judge his opinion regarding the democratic Texas Representative currently being held hostage by the texas Republicans in congress because she is refusing to sign a paper giving her freedom away by being under police guard

That is a good question. You would think they had no legal right to do this. I give her a lot of credit for refusing to sign on to the 24-hour police surveillance. The pits.

I saved a copy of his honor’s Atlantic article, having first become aware of Judge Luttig during the January 6th hearings (which I also saved.) Terry Moran’s jaw dropped expression in the Oval Office when DJT answered the question regarding what the Declaration of Independence means to him will stand out throughout history! He knows not one iota of the function of government or our nation’s history 🤩

Judge Luttig is our "Rule of Law Lighthouse". I am shocked at how quickly the people in the two institutions-Congress and the Supreme Court-that by Constitutional design should be a check on the Executive have not only failed to exercise their responsibility, but have enthusiastically supported this power grab. They have failed the American people. If we ever come out of this nightware there should be, at the Capitol, a "Wall of Shame" with the picture of all of the Individual Congressmen and Supreme Court judges that have willingly abdicated their Constitutional responsibilities.

I saw Judge Luttig interviewed by Sydney Blumenthal and Sean Wilenz. As a retired lawyer, I love this guy. He’s an old school republican, and stands for the law and constitutionality. He is straight up about CJ Roberts, btw..The bench and bar have been shamefully silent, and I don’t find him depressing. I find him realistic.

Plausible to say The Supreme Court has committed treason?

Expand full comment
John Kahler's avatar

Here we go again with not knowing the CONSTITUTIONAL definition of treason. Please name the foreign power we are at war with. Hell, though it is not enough to meet the constitutional requirement, name the foreign power that they are doing the bidding of. No, it is not plausible.

Expand full comment
Cyberchick's avatar

I was posing a rhetorical question in response to the troubling implications of the Court’s ruling—not submitting a legal brief. That said, treason isn’t the only concern here. Betrayal of the Constitution can come in forms that may not meet the narrow legal definition of “levying war” or “adhering to enemies,” but still erode democracy, enable authoritarianism, or violate public trust.

When a court issues rulings that shield a leader from accountability, delay justice, and enable power consolidation—all while ignoring or twisting precedent—many Americans see that as a moral and civic betrayal, if not a constitutional one. If you’d like to educate, do so constructively. Otherwise, condescension is just noise.
